Terms of service
What you are agreeing to when you use HamaraPG, and what we are agreeing to in return.
Read this first. This is a plain-English summary of how the service operates, written by the people who build it and not by a lawyer. It is accurate about the software; it has not been reviewed by counsel, and it should be before launch. Where a fact about the company itself is missing you will see a marked slot rather than an invented answer.
Effective from [UNFILLED: date these terms take effect]. The service is provided by Vedatricks Technologies Private Limited, of [UNFILLED: registered office address] — the company that operates HamaraPG (“HamaraPG”, “we”). Using the software or the public listings means you accept these terms.
1. What the service is
HamaraPG is software for running paying-guest and co-living accommodation in India: beds and occupancy, residents and agreements, rent and receipts, complaints, mess, staff, expenses, and — for operators who lease buildings rather than own them — landlords, payables and margin. It runs in a browser, including on a phone, and it can be installed as a web app. There is no separate native application, and nothing on this site claims one.
The site also hosts public PG listings, which are pages published by owners about their own buildings, and the enquiry form that goes with them.
2. Your account
- You must be 18 or older and legally able to enter into a contract.
- Give us details that are true, and keep them current — the phone number and email on the account are how you get back in and how receipts reach you.
- You are responsible for what happens under your account, including what the people you invite do with the permissions you give them. Every module has separate view and manage permissions and staff can be restricted to named properties; using them is your call.
- One-time codes, invite links and agreement links are credentials. Do not forward them. A portal invite link is single-use and expires; an agreement link displays a document and does not.
- Tell us promptly if you believe someone has got into your account.
3. Other people’s data is your responsibility
Nearly everything you put into HamaraPG is about somebody else: residents, their guardians, their KYC, your staff, your landlords. For that data you are the Data Fiduciary and we are your Processor — we hold it and secure it on your instructions and we do not use it for our own purposes. You must have a lawful basis for collecting it, tell the people concerned what you are doing with it, and answer their requests about it. Our privacy policy sets out the split in full.
4. Acceptable use
Do not use HamaraPG to break the law, and specifically:
- Do not list accommodation you have no right to let, or advertise a price, an availability or a facility that is not real.
- Do not use enquiry contact details for anything other than responding to that enquiry.
- Do not discriminate in letting decisions on any ground the law prohibits.
- Do not upload malware, attempt to reach another organisation’s data, probe or load-test the service without written permission, or scrape the listings in bulk.
- Do not resell, sublicense or white-label the software without our agreement in writing.
We may suspend an account that is doing any of these, and we will say why.
5. The public listings, and what we are not
A listing is published by the PG owner. We do not inspect the property, verify the owner, check the price, or guarantee that a bed exists. When you send an enquiry, your name and mobile number go to that owner so they can call you back; that is the whole mechanism, and it is described in the privacy policy.
Any tenancy, deposit, licence or payment that follows is between you and the PG. We are not a party to it, not an agent or broker for either side, and we do not hold anybody’s deposit. Disputes about a room, a refund of a deposit, or the conduct of a stay are between the resident and the PG. If a listing is misleading, tell us and we will look at the listing.
6. Plans, payment and taxes
- Free is genuinely free: 5 beds, no card, and no trial clock. Existing accounts that were given a larger free allowance keep it.
- Paid plans are prepaid for a fixed period — one month, or twelve months for an annual purchase — priced per bed on the quota you choose. Every rate is published on the pricing page.
- The quote you are shown before you pay is the amount charged. It is computed on our servers, and the payment link is built from that same figure, so the two cannot disagree.
- Payments are taken by Razorpay. A purchase can be a one-off payment link, which does not renew itself, or a UPI Autopay mandate, which does until it is cancelled. Which one you got is shown when you buy.
- Taxes and statutory charges, where they apply, are payable in addition or as shown at the time of payment. Our tax registration details: [UNFILLED: GSTIN or a statement that the entity is not registered for GST].
- Prices can change. A change never re-prices a period you have already paid for.
Cancellation and refunds have their own page: Refund and cancellation policy.
7. If a subscription lapses or you stop paying
Written out because it is the clause people assume the worst about. Nothing is deleted at any point in this sequence.
- When a paid period ends without a renewal, your features keep working for a further 14 days. What stops immediately is growth: you cannot add beds beyond what you paid for. Being late is an inconvenience, not an outage.
- After that window, the account becomes read-only. Every record stays reachable and nothing can be changed. We do this rather than lock you out because you still have residents in rooms, deposits you are holding, and filings to make against invoices this product issued.
- If you cancel deliberately, the product closes and only the billing screen stays open, so that paying again restores everything in one step. We do not block sign-in, because the renewal is behind that door.
- Your data remains yours throughout. Ask and we will help you get it out.
8. Availability, changes and support
We work to keep the service up and we do not promise a percentage. There will be maintenance, and there will be failures; we will keep them short and tell you what happened. Features change — we add, improve and occasionally retire things, and we will not remove something you depend on without notice inside the product.
Support is available on every plan, including the free one: raise a ticket from inside the application. Support is deliberately never gated on payment, because the one thing that must answer when everything else has been refused is the thing that reports it. Higher plans buy priority, not access. Contact carries our phone number, our email address and an enquiry form.
9. Who owns what
The software, the site and everything we wrote on it stay ours. Your data stays yours — we claim no ownership of your records and we do not sell them or use them to train anything. You give us only the permission we need to run the service for you: to store, process, transmit and display your data to the people you have given access to.
What you publish on a listing — photographs, descriptions, prices — you are telling us we may display on this site. You must actually own or be licensed to use the photographs you upload.
10. No advice
Writing on this site about GST, licensing, police verification, agreements or tax is orientation, not advice. Rules differ by state and by city and they change. Anything that matters, confirm with a CA or a lawyer. The software helps you keep records; it does not make you compliant.
11. Where our liability ends
The service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, or loss of business — and specifically not for a tenancy dispute, an unpaid rent, an unreturned deposit, or anything a PG owner or a resident does to the other. Our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim arose, and where you pay us nothing, our liability is limited accordingly. Nothing here excludes a liability that cannot lawfully be excluded.
You are responsible for keeping your own copies of anything you cannot afford to lose.
12. Ending it
You can stop at any time — cancel from the plan screen, and see the refund policy for what that means. We may suspend or end an account for a serious or repeated breach of these terms, or where we are required to by law; except in an emergency we will tell you first and give you a chance to fix it. On termination we will give you a reasonable opportunity to export your data before it is removed.
13. Changes to these terms
We will move the effective date at the top and, for a material change, tell account holders inside the product before it takes effect. Continuing to use the service after that means you accept the new version.
14. Law and jurisdiction
These terms are governed by the laws of India. The courts at [UNFILLED: city whose courts have exclusive jurisdiction] have exclusive jurisdiction, and we will both try to sort a dispute out directly before going near them.
15. Reaching us
The fastest route for an account holder is the support dock inside the product. Otherwise: info@hamarapg.com, or write to [UNFILLED: registered office address]. See Contact.
